By way of the present bail application, the applicant seeks grant of interim bail for a period of 30 days in FIR No. 1025/2024, registered at P.S. Bhalswa Dairy, for offences punishable under Sections 137(2), 143(5), 146, 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The relief is sought on the ground that the applicant's elder half-brother is suffering from cancer at a terminal stage, and that there is no other adult male member in the family to attend to him.

applicant's elder half-brother. Accordingly, status report has been filed on 11.01.2026.

By a subsequent order dated 14.01.2026, the Investigating Officer was directed to inform the prosecutrix and her family members about the pendency of the present bail application. Pursuant thereto, they are present today through video conference, and state that they do not wish to add anything further to the submissions to be advanced by Ms. Arya, learned APP.

The FIR in question pertains to an incident dated 22.12.2024, wherein two minor girls went missing from outside their residence in Delhi. Both the girls were recovered in Srinagar, during the course of investigation. The applicant's name surfaced during the interrogation of the person from whose house the children were recovered. The applicant was thereafter questioned and subsequently arrested on 14.08.2025. He is stated to be running a placement agency in Srinagar, to which the girls and other children were brought.

As per the said report, the Investigating Officer has confirmed from the hospital concerned in Srinagar, that the applicant's elder half-brother is suffering from Stage IV cancer and has been advised chemotherapy for four cycles. The next date of chemotherapy in the Cancer Society of Kashmir Chanapora, Srinagar, is 30.01.2026, and a further appointment has been fixed at Tata Cancer Hospital, Mumbai on 19.02.2026. 6.
The status report further discloses that the applicant's family comprises his mother, his elder half-brother - who is suffering from cancer, the applicant himself, and his sister. mother. Her first husband, who was the father of the applicant's elder half-brother (the patient), had expired when he was about two years old. The applicant is stated to have one other half-brother (the patient's real brother), who has been residing separately in the same locality for the last eight years. The status report also records that the applicant resides with the elder half-brother and their mother, and that no other adult male family member was found living with them during the course of inquiry. 7.
I am further informed that, insofar as the present proceedings are concerned, the chargesheet has already been filed and the matter is presently listed for framing of charges.

Mr. Irfan Firdous, learned counsel for the applicant, on instructions, submits that although the family will make arrangements for some other person to accompany the patient to his medical appointments in Srinagar and Mumbai, the applicant is required for making financial arrangements relating to the chemotherapy as well as for the appointment at Tata Memorial Hospital, Mumbai.

Having considered the aforesaid submissions, the nature of the allegations, contents of the status report, and the overall circumstances of the case, I am of the view that it is not appropriate to grant interim bail to the applicant for the entire period sought, so as to enable him to personally attend to his brother at all stages. The allegation concerns the applicant's involvement in an operation of trafficking of minor children, with several victims. There is also another half-brother of the applicant, who can attend to the medical needs of his elder half-brother, even if he lives separately.

However, I am of the view that interim bail for a limited period of ten days can be granted to the applicant, to enable him to make necessary financial arrangements.

At this stage, Mr. Firdous, on instructions received from the applicant's wife, who is present in Court, submits that the applicant will be able to make the necessary arrangements by remaining resident within the National Capital Region.

In the aforesaid circumstances, it is directed that the applicant be released on interim bail for a period of 10 days from the date of release, subject to furnishing a personal bond in the sum of Rs. 15,000/-, with one surety of the like amount to the satisfaction of the Jail Superintendent, and subject to the following conditions:
a) The applicant shall not leave Delhi NCR, and shall furnish the address at which he proposes to reside during the period of interim bail, to the Investigating Officer;
b) The applicant shall also provide his mobile number to the Investigating Officer/Station House Officer, which shall be kept in working condition at all times. The mobile number shall not be switched off or changed without prior intimation to the Investigating Officer during the period of interim bail; c) The applicant shall not contact the prosecutrix or any other witness in the present case, directly or indirectly;
d) The applicant shall not commit any other offence during the period of interim bail.

It is clarified that any observations made in the present order are solely for the purpose of deciding the present bail application and shall not influence the trial proceedings, nor shall they be construed as an expression of opinion on the merits of the case. 15.
