The learned counsel for the petitioner submits that he has instructions to withdraw the present petition. 2.
The learned counsel for Respondent No. 2/ complainant, however, submits that the petitioner, in the garb of the present petition, stating that the parties have settled their disputes, has made Respondent No.2 to comply with the terms of the obligations enumerated under Settlement Deed dated 20.12.2024. 3.
He submits that Respondent No. 2, pursuant to the settlement, has withdrawn certain litigations. He submits that the complainant also has no objection if the FIR is quashed subject to the petitioner complying with the terms of obligations as contained in the Settlement Deed dated 20.12.2024. 4.
Be that as it may, once the petitioner does not wish to pursue the proceedings, this Court cannot pass any order to the contrary.

petition. The settlement has not been arrived at between the parties pursuant to the orders passed by this Court. Therefore, even if it is to be presumed that the petitioner has taken the complainant for a ride by entering into a settlement, without having any intention to settle, no order can be passed in the present petition.

Respondent No.2 is at liberty to take all steps for restoration of her rights that may have been diverted/ diluted pursuant to the settlement, not limited only to civil remedies. 7.
If Respondent No.2 feels that she has been cheated in any manner, she is at liberty to file an appropriate complaint in that regard. The same, as and when filed, shall be looked into in accordance with law.

This Court does not consider it apposite to go into the factual details as narrated in the present application since the facts are disputed by Respondent No.2.

However, since the statement has been made by the learned counsel for the petitioner that the petitioner wants to withdraw the present petition, at the outset, without any adjudication of the proceedings, the present petition is dismissed as withdrawn.

All pending applications also stand disposed of. 11.
The date already fixed, that is, 27.05.2025, also stands cancelled.
