Petitioner has assailed order dated 23.12.2024 of the learned trial court, whereby his application under Order I Rule 10 CPC was dismissed. Paragraphs 12 and 13 of the impugned order bear the crux. 2.

After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to file appropriate suit pertaining to the election held on 26.03.2023. 3.

As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
