The present petition under Section 482 the Code of Criminal Procedure, 1973 (pari materia Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) assails the order dated 1st September, 2022 passed by the Trial Court in Complaint Case No. 20445/2016, whereby charges under Section 323 of the Bharatiya Nyaya Sanhita, 2023 were framed against the Petitioner, as well as the subsequent order dated 9th October, 2025 rejecting the Petitioner's discharge application. 2.

At the outset, counsel for the Petitioner submits that since a remedy of revision is available against the impugned order, the Petitioner intends to avail the same. He accordingly seeks leave to withdraw the present petition with liberty to file a revision petition against the impugned order. 3.

Leave and liberty as prayed for are granted.

The Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
