% 05.04.2018 It is submitted that petitioners and respondent no.2 are neighbours.
A quarrel took place on some trivial issue wherein petitioners assaulted respondent no.2 resulting grievous injury to him. However, with intervention of common friends and family members, petitioners and respondent no.2 have settled their disputes amicably vide compromise deed dated 12th December, 2017, therefore, FIR No.145/2016 under section 307/34 IPC registered at police station Kalyan Puri may be quashed.
During the course of hearing, petitioners offered `40,000/- to respondent no.2 towards compensation.
This amount has been accepted by respondent no.2. Petitioners have paid this amount of `40,000/- to respondent no.2 in the Court.
Keeping in view settlement arrived at between petitioners and respondent no.2, voluntarily, I am of the view that no fruitful purpose would be served by keeping criminal proceedings pending.
Accordingly, FIR No.145/2016 under section 307/34 IPC registered at police station Kalyan Puri and consequent proceedings emanating therefrom, are quashed.
Petition is disposed of in above terms. Dasti. A.K. PATHAK, J.
