This is an application filed on behalf of the plaintiff under Section 16 of the Court Fees Act, 1870 read with Section 151 of the Code of Civil Procedure, 1908, seeking issuance of court fee refund certificate in favour of the plaintiff's counsel.

The present suit was decreed and disposed of by this Court vide judgment dated 24.03.2026. It was held in the said judgment that the plaintiff is entitled for refund of court fees as per Section 16 of the Court Fees Act, 1870. 3.
The present application has been necessitated on account of the fact that the plaintiff is a company, incorporated in U.S.A. and it was not be possible to refund the Court Fees to the plaintiff since it does not have any bank account in India.

Accordingly, the plaintiff has through its Constituted Attorney namely, Mr. Harshit Gupta, has authorized the plaintiff's counsel, as detailed in para 3 of the present application, to accept the court fees refund certificate in its name. 5.
