HON'BLE MR. JUSTICE PURUSHAINDRA KUMAR KAURAV

O R D E R

% 07.01.2026 1.

It appears from the representation dated 21.11.2025 filed by the petitioner to the Chief Executive Officer, Delhi Urban Shelter Improvement Board (DUSIB) that the petitioner had requested for removal of the debris left after the demolition carried out by the said authority. 2.

If the provisions of Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 are perused, the same would clearly indicate that the petitioner‟s grievance would fall within the definition of the „public nuisance‟ and the concerned authority would be empowered to take appropriate action.

3.

In view thereof, learned counsel appearing for the petitioner, at this stage, seeks liberty to withdraw the petition with further liberty to approach the concerned authority.

4.

Accordingly, with the aforesaid liberty, the petition, along with pending application, stands dismissed as withdrawn. 5.

All the rights and contentions are left open. PURUSHAINDRA KUMAR KAURAV, J JANUARY 7, 2026 aks/amg The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 12/01/2026 at 12:43:08
