O R D E R

% 16.05.2018 Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. TIP was not held witness stated that he may not be able to identify the accused on account of lapse of time. It is submitted that petitioner be released on bail. Learned APP submits that that offence is serious in nature. Petitioner has been charged for the offences under Sections 364-A/368/34 IPC. Coaccused have already been convicted. While deposing in Court, during the trial of co-accused, victim child PW1 Master Ratnesh Kumar has specifically named the petitioner.

Petitioner evaded his arrest and was

declared proclaimed offender on 3rd December, 2001. After 13 years, he could be arrested.

Supplementary charge-sheet has been filed.

Trial is underway.

Victim is yet to be examined.

Petitioner has past criminal records. He is involved in 30 cases of heinous offences including murder and under the Gangster Act. List of cases has been annexed along with the status report.

Keeping in mind the totality of the facts and circumstances of this case, I do not find it to be a fit case to release the petitioner on bail. Bail application is dismissed.
