The Criminal Revision Petition under Section 397 and 401 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'CrPC') now known as Section 438 and 442 of Bhartiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioner, against the Order dated 21.11.2024 vide which the right of the prosecutrix to adduce her evidence on account of her nonappearance on three dates, has been closed. 2.

The sole ground agitated in the present Revision Petition is that the Prosecutrix was unable to appear on account of her poor health for which the medical documents have been annexed. opportunity be given to the Prosecutrix to get her cross-examination concluded.

It is further submitted that the prosecutrix undertakes to appear before the learned Trial Court on 24.03.2025, as is fixed before the Trial Court and her cross-examination be concluded. 4.

In view of the aforesaid submissions, the Revision Petition is allowed and one opportunity is granted to the Prosecutrix to appear before the learned Trial Court on 24.03.2025, which is the date already fixed to get her cross-examination recorded. No further opportunity of any kind shall be granted to either party.

The Revision Petition and pending Application are accordingly disposed of.
