O R D E R

The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.0057/2025 under Sections 498A/406/506/323/ 34 IPC registered at Police Station Bhalswa Dairy and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. Mr. Anand V. Khatri, learned APP for the State accepts notice.

The petitioner no.1 (husband), petitioner nos. 2 - 5, as well as, respondent no. 2 (wife), are present in Court and they have been identified by learned counsel for the petitioner, as well as, by the Investigating Officer ASI Narender PS Bhalswa Dairy.

no.1 and the respondent no. 2 was solemnized on 20.02.2022 according to Hindu Rites and Customs. From the said wedlock a male child namely Kartik was born.

The respondent no.2 lodged a complaint with the police alleging that the petitioner no.1 and his family members committed domestic violence and raised demand of dowry, which culminated into the registration of present FIR.

During pendency of the proceedings, the parties arrived at settlement, terms whereof have reduced in writing in the form of memorandum of understanding dated 05.12.2025, copy of which has been annexed as Annexure P-3 to the present petition.

It is a term of the settlement that the petitioner no.1 (husband) and respondent no.2 (wife) have been reunited and started living together as husband and wife since 08.09.2025.

The petition is also supported by the affidavit of the respondent no.2, who affirms the fact that the petitioner and the respondent no.2 are now residing together.

It is recorded in the affidavit that the parties have resolved all their disputes amicably without any coercion or pressure. 10.

The respondent no.2, on a query posed by the Court, states that she has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Consequently, the petition is allowed and the FIR No.0057/2025 under Sections 498A/406/506/323/34 IPC registered at Police Station Bhalswa Dairy alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 15.
