Petitioner/defendant has assailed order dated 27.10.2025 of the learned commercial court, whereby subject to cost, application of petitioner/defendant under Order XVIII Rule 17 CPC read with Section 151 CPC was allowed, restricting the remaining cross examination to be concluded within two hours, as the defence had already been struck off and earlier, the witness had already been cross-examined for about two hours. 2.

After addressing partly, learned counsel for petitioner/defendant on instructions seeks permission to withdraw this petition unconditionally. 3.

Accordingly, the petition and the accompanying application are dismissed as withdrawn.
