versus THE STATE GOVT OF NCT OF DELHI & ANR..... Respondents Through Mr. M.S. Oberoi, APP with ASI Kumher Singh, P.S. Jaitpur

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 09.04.2018 Notice.

Learned APP accepts notice for respondent no. 1.

Respondent no. 2 is present in Court along with their counsel and accepts notice.

It is submitted that petitioners and respondent no. 2 are related to each other. A quarrel took place between them on some trivial issues, which led to registration of FIR no. 30/2017 under Sections 509/323/34 IPC at police station Jaitpur on the complaint of respondent no. 2. With the interventions of elders in the family, petitioners and respondent no. 2 have settled their disputes amicably, vide a Compromise Deed dated 26th March, 2018;

therefore, aforesaid FIR and the consequent proceedings emanating therefrom may be quashed. Respondent no. 2 is present in Court along with her counsel and has been identified by ASI Kumher Singh of police station Jaitpur . Respondent no. 2 admits having settled the matter with petitioners of her own free will, voluntarily and without any undue force, pressure or coercion and has no objection in case FIR is quashed against the petitioners. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, FIR no. 30/2017 under Sections 509/323/34 IPC registered at police station Jaitpur and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
