The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC")] has been filed by the petitioner praying for quashing of FIR No. 186/2018 registered at Police Station Govind Puri for the offences punishable under Sections 279/338 of the Indian Penal Code, 1860 (hereinafter "IPC") and Sections 146/196 & 3/181 of the Motor Vehicles Act, 1988 (hereinafter "MV Act"). The brief facts of the case are that on 03.06.2018, respondent no. 3 was hit by motorcycle, allegedly driven rashly and negligently by the petitioner, resulting in injuries. Respondent no. 3 was taken to the hospital. On the complaint of respondent no. 2, the present FIR was registered. 3.

It is submitted that the petitioner and respondents no. 2 and 3 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future.

Settlement dated 09.07.2025 is on record and has been annexed as Annexure-C. Qua this settlement, the respondents no. 2 and 3 have agreed to withdraw the case arising out of FIR No. 186/2018 registered at Police Station Govind Puri against the petitioner.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 6.

Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioner seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Heard learned counsel for the parties and perused the record. 8.

The petitioner is present before this Court and has been identified by his counsel and Investigating Officer, Police Station Govind Puri. Respondents no. 2 and 3 are also present in the Court and have been identified by the Investigating Officer.

On a query made by this Court, respondents no. 2 and 3 have categorically stated that they have entered into compromise on their own free will and without any pressure. dispute has been amicably settled between the parties and respondent no. 3 has been duly compensated.

Keeping in view the fact that the matter stands amicably been settled between the petitioner and respondents no. 2 and 3 amicably without any pressure, and that respondents no. 2 and 3 want to put a quietus to the proceedings, no fruitful purpose would be served by keeping the matter pending.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR No. 186/2018 registered at Police Station Govind Puri for the offences punishable under Sections 279/338 of the IPC, Sections 146/196 & 3/181 of the MV Act and consequent proceedings emanating therefrom, are quashed qua the present petitioner.

The petition along with pending application(s), if any, stands disposed of.
