% 31.07.2018 This court had passed an order on 18.05.2018 and directed the respondent to fix a date to hear the petitioner and grant adequate opportunity of hearing before passing an order under Section 17(5) of the Customs Act, with respect to its bills of entries. It is stated that the petitioner could not avail the opportunity.
In these circumstances, the respondent - Deputy Commissioner of Customs is directed to hear the petitioner on 23.08.2018 at 11.30 AM. The petitioner shall avail the opportunity and present all the necessary documents which it chooses to rely upon. The Adjudicating Authority, after hearing the petitioner, shall pass a speaking order within a period of three weeks and communicate the same to the petitioner.
With aforesaid directions, the present writ petition is disposed of.
