The present petition has been filed under Section 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996 (hereinafter 'Act') seeking extension of mandate of the Arbitral Tribunal for a further period of six months.

It is stated that the matter is at the stage of final arguments before the Arbitral Tribunal.

Counsel appearing on behalf of the respondent on advance notice submits that a reference to Micro and Small Enterprise Facilitation Council (MSEFC) is under challenge as it is the case of the respondent that the petitioner is not a small enterprise under the MSMED Act, 2006. 4.

It is submitted by counsel for the respondent that a writ petition has also been filed on behalf of the respondent seeking direction to investigate whether the petitioner is an MSME or not and an inquiry has been initiated O.M.P.(MISC.)(COMM.) 1011/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. in this regard.

Counsel for the petitioner has handed over an order dated 4th December, passed by the coordinate bench in O.M.P.(MISC.)(COMM.) 993/2025 between the same parties, wherein after noting a similar objection raised by the respondent, the Court has granted extension of mandate of the Arbitral Tribunal under Section 29A of the Act. 6.

Accordingly, without prejudice to the aforesaid contention of the respondent, the mandate of the Arbitral Tribunal is extended for a further period of six (6) months from today.

Counsel for the petitioner submits that the mandate had otherwise expired on 30th November, 2025.

Accordingly, the period from the said date till today is also regularized.

The petition stands disposed of with the aforesaid directions.
