% 07.04.2015 The learned counsel for the petitioner has instructions to withdraw this writ petition but seeks an order of continuation of the stay which was granted by this Court till the disposal of the appeal (Appeal No. 4416/Del/2012) before the Income Tax Appellate Tribunal.

In other words, what the petitioner seeks is to withdraw the challenge of the constitutional validity of Section 254(2A) of the Income Tax Act, 1961.

The writ petition is dismissed as withdrawn. However, the stay granted by this Court shall continue till the disposal of the aforementioned appeal before the Income Tax Appellate Tribunal.
