Ms. Chopra, learned counsel for the respondent has taken up preliminary objection that no notice under Section 21 of the Arbitration and Conciliation Act, 1996 has been issued by the petitioner pursuant to the judgment passed by the Hon'ble Division Bench of this Court in FAO (COMM) 15/2021 dated 24.12.2024. Further, the respondent has accepted the said judgment and not chosen to challenge it. 2.

Mr. Nair, learned counsel for the petitioner seeks to withdraw the present petition with liberty to issue a fresh notice under Section 21 of the Arbitration and Conciliation Act, 1996 and thereafter, approach the Court for appointment of an Arbitrator.
