Second Regular Bail Application under Section 439 Cr.P.C has been filed on behalf of the Applicant in FIR No.677/2021 dated 09.09.2021 registered under Section 304B/498A/34 IPC. 2.
It is submitted that the Applicant is the father-in-law of the deceased and is in judicial custody since 09.09.2021. 3.
Brief facts are that the deceased got married to Rahul, the son of the Applicant on 10.05.2021 and shifted to Delhi where they started residing together in the rented premises. The Petitioner was a Contractual Halwai, living in separate premises. After about 10-15 days the deceased went back to her parental home where she made complaints of dowry demands.

the matrimonial home on 26.08.2021. As per the Complainant/father he came to meet the daughter on 06.09.2021 wherein she complained to being harassed with dowry demands. The girl committed suicide by hanging on 08.09.2021.

As per the Prosecution, the doctor who conducted the Post Mortem, recovered a purse in which there was a piece of paper aside from other things. The said paper turned out to be a Suicide Note wherein aside from dowry demands and allegations, it was mentioned that the husband with the Applicant/father-in-law, had committed rape upon her.

It is submitted that the recovery of the Suicide Note is suspect as the alleged purse was neither recovered by the Police or by the family members, but surprisingly by the doctor who conducted the Post Mortem.

It is further submitted that all the Prosecution Witnesses in the Main Chargesheet have been recorded and only a few remain from the Supplementary Chargesheet. No fruitful purpose would be served by keeping the Applicant who is aged about 50 years, in judicial custody. Hence the prayer is made for grant of bail.

Learned Prosecutor has submitted that there is sufficient material on record to show that the young girl within four months of her marriage, had been driven to commit suicide on account of dowry and harassment. Not only this, the Suicide Note clearly states that she had been raped by the Applicant. Considering the totality of circumstances and that majority of witnesses have been recorded and the accused is in judicial custody since 09.09.2021, the accused is granted Regular Bail, on the following terms and conditions:
a.
The Petitioner/accused shall furnish a personal bond of Rs. 25,000/- and one surety of like amount, subject to the satisfaction of the learned Trial Court.
b.
The Petitioner/accused shall appear before the Court as and when the matter is taken up for hearing;
c.
The Petitioner/accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times; d.
In case the Petitioner/accused changes his residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.
