Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners for quashing of FIR No. 0324/2020 under Sections 323/341/452/427/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station S.J. Enclave and all other proceedings emanating therefrom, in terms of the Settlement Deed dated 24.01.2024. 2.

Issue Notice.

Mr. Yudhvir Singh Chauhan, learned APP on behalf of the State, has appeared and accepted the Notice.

It is stated that the Petitioners were residing in the vicinity of Dominos Restaurant while Respondents No. 2 and 3 were the employees at the Dominos. The dispute is regarding the parking of vehicle in front of residence of Petitioners. It is stated that the parties have amicably settled all their disputes. The parties have amicably resolved their dispute vide Settlement Deed dated 24.01.2024 for a sum of Rs.30,000/- to be paid by the Petitioners to the Respondent No. 2 at the time of quashing. It is prayed that the present FIR No.0324/2020 be quashed, in terms of the Settlement. 5.

Statements of the parties have already been recorded before the learned Joint Registrar.

The parties are present before this Court in-person today and have been identified by their learned Counsel and Investigating Officer concerned. The parties have endorsed amicable settlement and accepted the terms thereof voluntarily.

The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 24.01.2024 and thus, no fruitful purpose will be served in continuing with the FIR.

The present Petition has been signed by the Petitioners and is supported by their Affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Settlement Deed dated 24.01.2024 and they also submit that the said Settlement Deed has been arrived at between the parties, without any pressure and coercion.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to neighbourhood, no useful purpose will be served in continuing with the proceedings, rather the same The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. 0324/2020 under Sections 323/341/452/427/34 of the IPC registered at Police Station S.J. Enclave and all other proceedings emanating therefrom are quashed.
