The respondents in their counter affidavit have stated that the applicable payment for a sum of Rs.21,78,400/- with TDS was released to the petitioner. However, a sum of Rs.9,74,100/- was deducted on account of late reporting i.e., beyond the prescribed time limits (24 Hours/ 12 hours as the case may be).

It is, therefore, submitted that the deduction of the said amount is fully justified in view of the terms and conditions of the orders issued by the competent authority from time to time.

Having considered the overall facts and circumstances of the instant case, the Court finds that the parties will have to lead evidence to justify their claim(s). respect to timely submission of the reports, the Court under Article 226 of the Constitution of India may not be able to adjudicate those aspects. 4.

The petitioner shall be at liberty to file a civil suit or to avail any other alternative remedy permissible in accordance with law. 5.

With the aforesaid observations and liberty, the instant petition stands disposed of.

All rights and contentions of the parties are left open.
