The present petition under Section 482 of the Code of Criminal Procedure, 1073 and Section 528 of Bhartiya Nagarika Suraksha Sanhita, 2023 has been filed, seeking quashing of FIR No. 0287/2022 dated 03rd March, 2022 registered at PS, Model Town under Sections 498A, 406 and 34 of the IPC. The Petitioner argues that the FIR has been registered on account of a frivolous and doctored complaint dated 05th October, 2021, filed by Respondent No. 2. The Petitioner raises objections as to the period of limitation in filing of the FIR as well as the territorial jurisdiction of the Court to take cognizance of the FIR.

After making some submissions, counsel for the Petitioner, on instructions, states that he would like to withdraw the present petition and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. seeks liberty to raise the grounds urged in the present petition before the concerned Court, at the stage of framing of charge. 3.
In light of the above, the present writ petition is dismissed as withdrawn with liberty as aforesaid. It is made clear that the Petitioner shall be entitled to raise all grounds urged in the present petition including the plea of limitation as well as territorial jurisdiction before the concerned Court.
