This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India challenging the impugned demolition notice dated 02.12.2025 issued by DDA as also for protecting the peaceful possession of the Petitioner over subject land bearing Khasra No. 6/2, Madangir Village, New Delhi.

the notice is completely bereft of the details of the address and description of the land from which alleged encroachments are sought to be removed and/or the land which is sought to be reclaimed by DDA. It is pointed out that even the names of the noticees are not mentioned in the impugned notice and this only reflects non-application of mind by the Competent Authority. 5.
Issue notice.

Mr. Sanjay Katyal, learned Standing Counsel accepts notice on behalf of the Respondent and on instructions, fairly submits that the impugned notice will be withdrawn but liberty be granted to DDA to issue fresh notice in accordance with law.

In light of the stand of DDA that impugned notice shall be withdrawn, no further order is required to be passed in this writ petition and the same is accordingly disposed of with no expression on merits of the case. It is left open to DDA to issue fresh notice, if so advised, in accordance with law. 8.
Needless to state, if fresh notice is received by the Petitioner, it shall be at liberty to take recourse to available legal remedies. 9.
Pending application stands disposed of.
