% 11.04.2018 Learned counsel for the petitioner fairly submits that the period of sixty days as provided in the Arbitration Agreement to the respondent to appoint an Arbitrator on a request, has not expired and the present petition is pre-mature.

He prays for leave to withdraw the present petition with liberty to file afresh in case need so arises.

The petition along with the pending application is dismissed as withdrawn with liberty as prayed for.
