O R D E R

The present petition has been filed by the petitioner, who is a Class 'C' enlisted contractor under Index No. C-1200 and has been associated with Military Engineering Services (MES), praying as under - "a) Issue a writ of mandamus or any other appropriate writ, order or direction quashing the impugned rejection letter dated 08.02.2022, passed by Respondent No. 2, and direct the Respondents to approve the renewal/enlistment of the Petitioner.

b) Issue a writ of Mandamus or any other appropriate writ, order or direction, directing Respondent No. 1 (Engineer-in-Chief) to adjudicate the appeal dated 17.02.2022 filed by the Petitioner against the rejection letter dated 08.02.2022 issued by Respondent No. 2 within a time-bound manner as may be fixed by this Hon'ble Court. c) Issue a writ of Mandamus or any other appropriate writ, order or direction, directing Respondents to grant enlistment to Petitioner for the cyclic period of 2021-2025 in terms of policy letter dated and 2026-2032 in terms of policy letter dated 11.03.2025."

letter dated 08.02.2022 on the alleged ground that no reply was submitted by the petitioner to the Show Cause Notice dated 19.08.2021. It is submitted that the factum of the petitioner's having submitted its reply to the SCN is evident from the record.

During the course of the hearing, learned counsel for the petitioner confines himself to seeking that the petitioner's appeal, filed as far back as on 17.02.2022, be decided expeditiously.

It is pointed out that the outcome of the appeal will have a bearing on the petitioner's entitlement to his enlistment during the next renewal cycle i.e., 2026-2032.

Considering the limited nature of the relief sought, the petition is disposed of with a direction to the concerned authority/Engineer-in-Chief to decide the petitioner's appeal dated 17.02.2022 as expeditiously as possible, and in any event, within a period of four weeks from today. Further, it is directed that in the event of the petitioner's succeeding in the appeal, the petitioner's request for renewal of his enlistment during the next period be duly considered.
