Petitioner seeks quashing of FIR No.66/2007, under Sections 279/338 IPC, Police Station Civil Lines, based on a Settlement. 2.

The offence under Section IPC has already been compounded by the Trial Court by order dated 29.01.2018. 3.

Respondent No.2 has filed an affidavit confirming that Settlement has taken place and respondent No.2 has no objection to the quashing of the subject FIR.

Respondent No.2 is present in Court in person, represented by counsel and is identified by the Investigating Officer. He confirms that a settlement has been arrived at between the parties and further submits that he has no objection to the quashing of the FIR. 5.

In view of the above and keeping in view of the fact that the offence under Section 338 IPC has already been compounded by the Trial Court by order dated 29.01.2018 and parties have resolved their dispute through a Settlement and further respondent No.2 does not wish to press his complaint any further, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.66/2007, under Sections 279/338 IPC, Police Station Civil Lines and the consequent proceedings emanating therefrom are hereby quashed.
