CM APPL.26217/2025 (filed on behalf of petitioner seeking compliance of order dated 14.01.2025) 1.

The present application has been filed alleging non-compliance with the directions contained in the order dated 14.01.2025. The said order reads as under:

"3. The present petition has been filed by the petitioner seeking a direction against the respondent no.1 to release the ex-gratia compensation of Rs.1 Crore, to which the petitioner claims to be entitled as per the extant policy of the Government of NCT Delhi (respondent no.1), on account of the fact that the mother of the petitioner contracted Covid-19, while being on official duty, and died on 02.05.2021.

4. It is submitted that for the purpose of release of the said ex-gratia compensation, certain documents were sought from the petitioner which have been duly provided. However, the respondents have not yet taken the requisite decision / released the amount to the petitioner.

5. After some hearing, the present petition is disposed of with a direction to the respondent no.1 to examine the claim of the petitioner and take an appropriate decision / release the requisite amount. Let the verification of the petitioner's claim be carried out expeditiously and an appropriate decision thereupon be taken within a period of eight weeks from today.

If any further document/s are required from the petitioner for the purpose of processing the claim and / or to take a decision, the same shall be duly The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. intimated to the petitioner.

7. Needless to say, if the petitioner is aggrieved with the outcome of the aforesaid exercise, he shall be at liberty to avail appropriate remedies under law."

It is the case of learned counsel for Govt. of NCT of Delhi (GNCTD)/respondent no.1 that some documents from the Municipal Corporation of Delhi (MCD)/respondent no.2 are still awaited. However, learned counsel for the respondent no.2 strongly refutes the same. 3.

In the circumstances, it is evident that the processing of the petitioner's claim is being unnecessarily delayed for no fault of the petitioner and the petitioner is caught between the divergent and contrary positions taken by the GNCTD and MCD.

In the circumstances, the Chief Secretary, GNCTD, as also the Commissioner, MCD are both directed to depute a responsible officer to interactively process the case of the petitioner for grant of ex-gratia compensation to the family of the deceased.

If the case qualifies for grant of ex-gratia compensation, the same shall be disbursed to the concerned family members of the deceased within a period of eight weeks from today.

The petition is disposed of in the above terms. 7.

In case of non-compliance, the concerned official/s of the GNCTD and the MCD shall remain present in Court on the next date of hearing.
