This writ petition is preferred on behalf of the Petitioner under Article 226 of the Constitution of India alleging illegal and unauthorised construction by Respondent No.5 on the agricultural land/property bearing No.42, Green Avenue, Vasant Kunj, New Delhi.

Learned counsels, as above, accept notice on behalf of respective Respondents.

Learned counsel for Respondent No.2/Special Task Force ('STF') submits that on a complaint received from the Petitioner, the same was looked into and the matter was referred to Municipal Corporation of Delhi ('MCD') for appropriate action.

Learned counsel for Respondent No.1/MCD, on instructions, states that on 12.01.2024, a show cause notice was issued to Respondent No.5, after which he started fresh construction and another show cause notice has been issued on 13.01.2025 and demolition is scheduled for 17.01.2025. 8.
In view of the stand taken by Respondents No.1 and 2, no further orders are required to be passed in the present petition at this stage. 9.
Accordingly, the writ petition stands disposed of along with the pending application. Needless to state that MCD will take appropriate action ensuring all statutory compliances and keeping in mind the judgment of the Supreme Court in In Re: Directions in the matter of demolition of structures, 2024 SCC OnLine SC 3291.
