The learned counsel for the petitioner at the outset, on the instructions, states that he is not pressing for summoning of Respondent Nos. 3 to 8 for offences under Section 376(2)(n)/377/313/506 of the Indian Penal Code, 1860 ('IPC'). 2.

He submits that the facts which have emerged during the course of the investigation and trial indicate that the Respondent Nos. 3 to 8 have deceived the petitioner and fraudulently induced her to enter into a settlement and withdraw the original complaint.

He seeks liberty to file an appropriate application before the learned Trial Court seeking summoning of Respondent No. 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to 8 under the relevant provisions and withdrawal of the present petition.

In view of the above, the present petition is dismissed as withdrawn with liberty to the petitioner to file an appropriate application before the learned Trial Court.

It is made clear that this Court has not given any opinion on the merits of the dispute or the arguments raised by the petitioner and the application as and when filed shall be decided in accordance with the law after giving opportunity to the respondents.
