O R D E R

% 24.04.2018 Learned senior counsel for the respondent, who appears on advance notice, submits that the Arbitrator has already been appointed by the respondent in terms of clause 23 of the Agreement dated 22nd May, 2013. In view of the same, the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 would not be maintainable. The petition and the application are accordingly dismissed. It is however made clear that this Court has not expressed any opinion on the validity of the appointment of the Arbitrator made by the respondent or his authority.
