O R D E R

% 25.07.2018 By this petition, the petitioner seeks modification of the order dated 17th October, 2017 whereby first spell of furlough was granted to the petitioner subject to his furnishing a surety bond in the sum of ₹10,000 and a personal bond in the like amount to the satisfaction of the Superintendent Central Jail, Tihar. The petitioner applied twice for modification of that order seeking that he be permitted to furnish cash surety which were dismissed.

Petitioner who is present in Court states that earlier both the time he availed the parole as his mother stood surety for him, however, since she has fractured her arm and is now at her native place in Bhagalpur, she is not in a position to come and furnish the surety bond. furnish cash surety.

Considering the facts noted above and also the fact that the verification was done which shows that brother and sister-in-law of the petitioner are residing at H.No. Basant Dada Patil Nagar, Bhalaswa Dairy, Delhi who do not wish to stand surety for the petitioner and the mother of the petitioner who stood surety is in Bhagalpur, the order dated 17th October, 2017 granting the First spell of furlough to the petitioner for a period of three weeks is modified to the extent that clause-1 of the said order would now be read as 'the petitioner is permitted to furnish a surety for a sum of ₹10,000/- by way of cash surety along with a personal bond of the like amount for his release on furlough to the satisfaction of the Superintendent, Central Jail, Tihar'. Rest of the conditions imposed in the order dated 17th October, 2017 granting furlough will remain same. Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
