Learned counsel for petitioner submits that the limited prayer in the petition is for issuing directions to the Trial Court to dispose of the application under Order VII Rule 11 CPC on the next date before the Trial Court i.e. 30.01.2025.

It is revealed from the record that petitioner filed a petition under Section 25 of the Guardians and Wards Act, 1890, seeking visitation and interim custody of the child. On 16.11.2023, respondent filed an application under Order VII Rule 11 CPC, which has got adjourned from time to time. grant of visitation rights could not be decided because of pendency of application under Order VII Rule 11 CPC.

Considering the fact that the application under Order VII Rule 11 CPC is pending since more than a year, the petition is disposed of with direction to the Trial Court to make the best possible endeavour to dispose of the application by the next date i.e. on 30.01.2025. Both parties are directed to render their due cooperation to the Trial Court in disposal of the application.
