This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is directed against orders dated 19th November, 2025 and 30th August, 2025, passed by the JMFC, Karkardooma Courts, New Delhi in Complaint Case No. 3949/2019.

The Petitioner is arrayed as an accused in the aforesaid complaint case filed under Section 138 of the Negotiable Instruments Act, 1881. The grievance of the Petitioner is with respect to order dated 19th November, 2025, whereby the Trial Court has directed her to furnish bail bonds and pay costs of INR 5,000/- to the complainant, failing which coercive steps have been indicated. For this purpose, the matter is listed before the Trial Court on 12th December, 2025.

It is noted that the Trial Court was constrained to pass the impugned order in view of the persistent non-compliance by the accused persons, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. including the Petitioner, with respect to furnishing bail bonds. In fact, nonbailable warrants had earlier been issued against the Petitioner. 4.

Counsel for the Petitioner submits that the Petitioner is a student pursuing a Master's degree in Business Administration at Jabalpur and is presently unable to appear before the Trial Court on account of her ongoing examinations. It is submitted that she shall appear before the Trial Court immediately upon conclusion of the same.

In light of the foregoing, having regard to the peculiar facts and circumstances, the direction imposing costs on the Petitioner is hereby waived. She is exempted from appearance on 12th December, 2025. The Petitioner is directed to appear before the Trial Court on 20th January, 2026, or any other date as directed by the Court thereafter, for the purpose of furnishing bail bonds in accordance with the Trial Court's directions. 6.

The Court has not commented on the merits of the case. All rights and contentions of the parties are kept open.

With the above directions, the petition is disposed of along with pending applications.
