% 13.03.2019 Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file a review under Section 77(1)(f) of the Patents Act.

The writ petition is dismissed as withdrawn with liberty as prayed for. If the review is filed by the petitioner within thirty days from today, the Deputy Controller of Patents, respondent No.2 shall consider the review on merits and the department shall not raise the objection of limitation. Pending application is disposed of.
