Counsel for the plaintiff states that plaintiff agrees that this suit was ill-advised to be filed and therefore plaintiff's attorney who is present in person has given instructions to the counsel for the plaintiff to withdraw the suit.

I may note that this Court was inclined in fact not only to impose exemplary costs for this totally frivolous litigation by the plaintiff but also this Court was inclined to issue criminal proceedings against the plaintiff under Section 340 Cr.P.C. in view of the fact that the issue urged in this suit is the issue which has achieved finality as against the plaintiff in the earlier litigation which reached right till the Supreme Court.

Since this suit is being withdrawn, this Court is refraining from imposing exemplary costs on the plaintiff and from issuing criminal process against the plaintiff.
