The present writ petition has been filed seeking declaration of the building, i.e. property bearing Nos. 5867, 5868, 5871 and 5672, Basti Harphool Singh, Sadar Bazar, New Delhi-110006 ('subject property'), as dangerous and ruinous, as per the statutory provisions. There is further prayer for directions to the Municipal Corporation of Delhi ('MCD') to take action against the subject property.

Status report has been filed on behalf of respondent/MCD wherein it is stated that subject property was inspected on 9th December, 2025 and 10th December, 2025. It is further stated that the overall maintenance of the building is of poor quality and the outer walls are deteriorated. The relevant extracts of the status report are set out below:- "... 3. That the subject property was inspected by officials of the Municipal Corporation of Delhi on 09.12.2025 and 10.12.2025. During the inspection, it was found that property bearing No. 5867,5868, 5871 and 5872, Basti Harphool Singh, Sadar Bazar, New Delhi-l10006 comprises ground floor and first floor, with a mezzanine W.P.(C) 18893/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. floor constructed in between.
4. That upon visual inspection of the property, it was observed that the overall maintenance of the building is of very poor quality. The plaster on the outer walls is deteriorated and crumbling at several places. Vegetation and plants have also sprouted on the external walls of the building. The structure requires urgent repair and maintenance, including strengthening of structural elements.

That it was further observed that the owner/occupier has removed several load-bearing walls at the ground floor level on the right-hand side portion of the property and has also installed a large rolling shutter. As a consequence of these unauthorized additions and alterations, cracks have developed on the first floor on the right-hand side of the building.
6. That it was also observed that shops exist at the rear side of the premises.
7. That at present, no imminent danger to the structure has been observed. However, if the owner/occupier continues to interfere with or alter the structural components of the building, the same may compromise the overall stability of the structure and may pose a serious risk to the life and safety of occupants and the public at large.

In view of the aforesaid status report, the relief sought in the present writ petition cannot be granted.
