This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "i) issue any appropriate writ, order or direction, directing the respondents and more particularly to respondent National Council For Hotel Management and Catering Technology to forthwith consider and allow petitioner's case for re-examination of 3 practical subjects namely, 112P - Food & Beverage Service Practical (1st Semester), 113P - Front Office Practical (1st Semester) and 313P - Front Office Practical (5th Semester) of B.Sc (HHA) in respondent Institute of Hotel Management Ahmedabad by invoking Rule 16.2 of NCHMCT Examination Rules, 2018 (Revised);

ii) pass any other order or direction or such further orders as may be deemed just and appropriate, in the facts and circumstances of the case and also in the interest of justice, in favour of the petitioner.= W.P.(C) 18911/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Counsels, as above, accept notice on behalf of the respective Respondents.

After canvassing some arguments, Mr. K.K. Rai, learned Senior Counsel for the Petitioner submits that at this stage Petitioner will be satisfied if he is permitted to make representation to Respondents No.2 and 3 bringing forth the reasons for not appearing in the examinations from time to time along with requisite documents. He further submits that representation be considered in terms of Rule 16.2 of National Council for Hotel Management and Catering Technology Examination Rules, 2018 (8Examination Rules 20189).

Accordingly, without entering into the merits of this case and expressing any opinion thereon, this writ petition is disposed of giving liberty to the Petitioner to make representation to Respondents No.2 and 3. As and when the representation is received the same shall be decided in accordance with law by passing a reasoned and speaking order within six weeks from the date of receipt of representation. Needless to state that while considering the representation, Respondents will take into consideration the Rule 16.2 of Examination Rules 2018.
