The petitioner by way of complaint dated 01.09.2025 appears to have approached the District Magistrate under Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023) highlighting the public nuisance.

The complaint which has been brought on record as Annexure-P-11 does not bear the signature of the petitioner. Though, the petitioner submits that it was signed and sent to the authority, but in absence of any concrete proof, the same position cannot be accepted.

duly signed and supported by an affidavit before the District Magistrate. 4.
Let the same be done within a period of seven (7) days from today. 5.
On doing so, let the concerned District Magistrate to take the complaint of the petitioner to its logical conclusion after affording opportunity of hearing to the petitioner. The status report filed by the MCD can also be enclosed along with the complaint. All those aspects can be looked into by the concerned District Magistrate. 6.
If the petitioner, thereafter, has any grievance, he shall be at liberty to take appropriate recourse in accordance with law. 7.
With the aforesaid observations and liberty, the instant petition stands disposed of along with all pending application, if any.
