O R D E R

% 06.04.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks parole for a period of 04 weeks in case FIR No.90/2012 registered under sections 365/392/397/302/411/34 of the Indian Penal Code, 1860 at P.S.: Chandni Mahal, Delhi.

Representation dated 08.12.2025 made by the petitioner to the jail authorities seeking parole for a period of 04 weeks has been pending ever since.

Mr. Utkarsh Singh, learned counsel for the petitioner submits, that the petitioner's wife needs urgent surgical intervention. During the pendency of the present petition, the petitioner's mother has also passed-away; and that there is no one apart from the petitioner to take care of his wife.

Notice on this petition was issued on 17.12.2025. Status Report dated 24.02.2026 has been filed.

The status report records that the attending doctor has been unable to verify the treatment papers since they are incomplete; and furthermore, that the requisite ultrasound report is also not verified. 6.

Mr. Singh submits, that the petitioner's wife is residing alone with their 02 minor children; and is unable to follow-up on the medical treatment and surgery which has been pending since December 2025. 7.

Counsel further submits, that the petitioner needs to arrange for funds as well as arrange for the surgery at the Dr. Ram Manohar Lohia Hospital, New Delhi. Counsel draws attention to OPD follow-up card placed at Annexure P-1 of the present petition to point-out, that the doctors had advised the wife admission on 08.12.2025, which however has not fructified.

The petitioner's Nominal Roll dated 19.03.2026 received from the Jail Superintendent shows that the petitioner has undergone judicial custody for more than 12 years as of 19.03.2026; that his jail conduct has been 'Satisfactory'; that he has been serving as langar sahayak ; and that he has no other criminal involvements. The nominal roll further shows that the petitioner has been granted parole on 04 occasions and furlough on 12 occasions previously.

In the circumstances, Mr. Yasir Rauf Ansari, learned ASC appearing on behalf of the State leaves it to the court to pass appropriate orders.

10. Considering the circumstances of the case, based on the documents on record and the medical ground cited, this court is persuaded to allow the present petition.

11. Accordingly, the petitioner - Md. Yasir s/o Md. Sadiq - is granted parole for a period of 04 weeks from the date of his release subject to the following conditions :

11.1. The petitioner shall furnish a personal bond in the sum of Rs. 20,000/- (Rs. Twenty Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;

11.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address as per prison records/as mentioned in the petition ; 11.3. The petitioner shall present himself before the S.H.O., P.S.: Chandni Mahal every Monday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose ;

11.4. The petitioner shall furnish to the S.H.O., P.S.: Chandni Mahal a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switchedon at all times ; 11.5. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

11.6. The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any;

11.7. Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

12. A copy of this order be sent to the concerned Jail Superintendent forthwith.
