Writ Petition under Article 226 of Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Petitioners seeking quashing of FIR No. 0697/2024 registered under Sections 115(2)/123/85/351(2)/3(5) BNS at P.S. Ranhola, Delhi and all the proceedings emanating therefrom in terms of the MOU dated 05.12.2025. 2.

It is submitted that marriage of Petitioner No.1-husband with Respondent No.2-wife was solemnized on 20.02.2022 as per Hindu Rites and Customs and out of their wedlock, a male child, namely, Master Kartik was born. However, due to temperamental differences, Respondent No. 2 and the Petitioner No. 1 started living separately. 3.

Respondent No. 2, FIR No. 0697/2024 was registered under Sections 115(2)/123/85/351(2)/3(5) BNS at P.S. Ranhola wherein the Petitioners were implicated.

Petitioner No. 1-Manish Kumar and Respondent No. 2/ComplainantManju are present in the Court while the other Petitioners are appearing through VC and they all are identified by the Investigating Officer. 5.

The parties submit that they had a marital discord because of which the Petitioner No. 1 consumed rat killing poison while the Respondent No. 2 was made to drink Harpic by the family members of the Petitioner No. 1. However, both were taken to hospital and have survived. Now, they are living separately from the family members since last 06 months and have no matrimonial dispute.

It is submitted that with the intervention of family members, relatives and well wishers, Petitioner No.1 and Respondent No.2 have resolved their disputes and arrived at an amicable settlement, terms whereof have been recorded in MOU dated 05.12.2025.

It is submitted by the parties that they have arrived at a settlement without any force, coercion and undue influence and pressure and they have signed the MOU dated 05.12.2025 voluntarily with their wish and will. 8.

Learned Counsel for Petitioners submits that the parties have been happily living together for the last 06 months and no grievance against each other survives and since Respondent No.2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR No. 0697/2024, the present Petition be allowed and FIR registered against the Petitioners be quashed.

In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner No.1 and Respondent No.2, which has been amicably resolved in term of MOU dated 05.12.2025 and the fact that parties have been living together for last 06 months and also that Respondent No.2 has given „no objection‟ to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No. 0697/2024 registered under Sections 115(2)/123/85/351(2)/3(5) BNS at P.S. Ranhola and proceedings emanating therefrom are hereby quashed.
