% 15.01.2025 CRL.M.A. 969/2025 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(CRL) 112/2025 1.

This is a petition seeking directions against the respondent No. 2 i.e. the SDM, Rohini to decide the proceedings under section 145 of CrPC.

It is stated by Mr. Dabas, learned counsel for the petitioner that the proceedings under section 145 of CrPC have been pending for the last more than 10 years and the same is contrary to the purpose for which section 145 proceedings are initiated.

Issue notice. Mr. Ansari, learned ASC accepts notice for respondent No. 3 and states that the delay presumably could be because of the fact that the matter was decided twice and was remanded back twice.

However, for the order I propose to pass, I do not think fit to issue notice to the other respondents.

It is directed that the concerned SDM shall conclude and pass the necessary order in accordance with law within a period of 12 weeks from today.
