This is an application on behalf of the Petitioner for condonation of delay in re-filing.

For the reasons stated in the application, the delay of 10 days in refiling is condoned. 3.

This is a petition under Section 29A (5) of the Arbitration & Conciliation Act for extension of mandate of the Arbitrator for a period of six months for making the award.

parties under the Apple Authorised Reseller Agreement dated 10.08.2018 executed between the parties.

Since disputes arose between the parties, the Petitioner approached this Court seeking appointment of an Arbitrator. It is stated that this Court vide Order dated 02.03.2022 in ARB. P 252/2022 appointed the Sole Arbitrator. This Court vide Order dated 20.05.2024 extended the mandate of the Arbitrator upto 31.12.2024. It is stated that the arbitration proceedings are at the stage of final arguments. It is stated that since the mandate of the Arbitrator has come to an end on 31.12.2024, the Petitioner has approached this Court seeking extension of mandate.

It is stated by learned Counsel for the parties that the matter is coming up for final arguments. In view of the above, this Court is inclined to extend the mandate of the Arbitral Tribunal for a period of nine months from 31.12.2024 so that the award can be passed in the matter. The mandate is extended till 30.09.2025.
