This writ petition is preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following relief:- "a) Issue a writ of Mandamus or appropriate writ, direction or order for directing the Respondent to process the application of the Petitioner having Service Order Number ONALN2708241937 (Annexure P-3) seeking a new electricity connection for the Property M-167, 1st Floor, Greater Kailash Part II, New Delhi - 110048 in a time bound manner and provide a new electricity connection to the Petitioner at the earliest" 4.

approaching the Consumer Grievance Redressal Forum under Section 42(5) of the Electricity Act, 2003 ('2003 Act'), whereafter there is a remedy of approaching the Ombudsman under Section 42(6) of the 2003 Act and relies on the judgment of the Co-ordinate Bench of this Court in Mr. Amrit Singh v. BSES Rajdhani Power Ltd. (BRPL) and Anr., W.P. (C) No. 10079/2024, decided on 24.07.2024.

At this stage, learned counsel for the Petitioner, on instructions, seeks to withdraw this writ petition to avail the statutory remedy under Section 42(5) of the 2003 Act. He, however, prays that since the matter relates to electricity connection and the Petitioner has been approaching the Respondent for a long time and they have been raising one objection after another, a direction be issued to the CGRF to expeditiously dispose of the petition, as and when the Petitioner approaches the said forum. 6.

Accordingly, writ petition is disposed of as withdrawn with liberty to the Petitioner to take recourse to remedy under Section 42 (5) of the 2003 Act.

Considering the nature of the relief sought, as and when the Petitioner approaches CGRF, every endeavour will be made to decide the application expeditiously and not later than two months from the date of first hearing. 8.
