This appeal is disposed of with the consent order by setting aside the impugned judgment dated 3.1.2018, allowing both the parties now to lead fresh evidence in support of their respective cases. It is clarified that though evidence of the respondent/defendant was closed, respondent/defendant will now be allowed to lead evidence after the appellant/plaintiff completes its evidence.

Trial court will now decide the suit at the stage of final arguments after evidence is led by both the parties.

Parties to appear before the District and Sessions Judge, Central
