The present petition has been filed seeking a direction to the learned Trial Court to expedite and complete the trial of the case in FIR No. 416/2020 registered under Sections 376/419 IPC at Police Station Karol Bagh, pending before the Court of learned Additional Sessions Judge (FTSC) (RC), Central District, Tis Hazari Courts, Delhi. 4.

Learned counsel appearing on behalf of the petitioner submits that the only material witness in the present case is the prosecutrix herself, who is presently residing in U.K.

He submits that since framing of charge, the matter has been listed 22 times for prosecution evidence and only two witnesses have been examined out of 12 witnesses cited by the prosecution. He submits that the prosecutrix herself is not coming forward for recording of her testimony, on account of which the petitioner's bail application is not being considered favourably and the petitioner is languishing in jail since 20.10.2020. He, therefore, urges the Court that a direction may be given to the learned Trial Court to conclude the trial in time bound manner.

In view of the above, issue notice. Learned standing counsel appearing on behalf of the State accepts notice. He submits that the State has no objection in case the directions for expeditious disposal are given to the learned Trial Court.

Having regard to the grievance articulated by the learned counsel for the petitioner, the learned Trial Court is requested to conclude the trial in case FIR No. 416/2020 registered under Sections 376/419 IPC at Police Station Karol Bagh, expeditiously, preferably within a period of one year. 8.

With the aforesaid directions, the present petition is disposed of. 9.

Registry is directed to send a copy of this order to the learned Trial Court.

A copy of this order be also sent to the concerned Jail Superintendent, who shall bring this order to the notice of the petitioner.
