% 26.03.2025 I.A. 7846/2025 (Under Order VII Rule 14 CPC) 1.

The present application has been filed by the plaintiff under Order VII Rule 10 of Code of Civil Procedure, 1908 ('CPC') seeking the following reliefs: - "A. Take on record the subsequent sale deed dated 16.01.2025 executed by the seller (father of the plaintiff) in favour of the plaintiff; B. Considering the aforesaid sale deed, the value of the property being Rs.1,23,58,861/- (Rupees one crore twenty-three lakh fifty eight thousand eight hundred sixty one), the suit falls within the pecuniary jurisdiction of the District Judge, South-East, Saket Courts, New Delhi, and that the plaint may be returned to the plaintiff for being filed before the appropriate Court."

Learned counsel for the plaintiff states that after the filing of the captioned suit, sale deed dated 16.01.2025 has been executed in favour of the plaintiff by the seller.

including the cost of land and cost of construction is valuated at Rs. 1,23,58,861/-. He states that in view of the aforesaid valuation, the suit property falls within the pecuniary jurisdiction of the District Court. 4.

He states that in these facts, the plaintiff seeks leave for return of the plaint, to be presented before the appropriate District Court. 5.

Accordingly, the application is allowed. The Registry is directed to return the plaint along with Court fee, in accordance with the Rules within four (4) weeks.

The application stands disposed of.

The suit stands disposed of along with pending applications. 8.

Future dates are cancelled.
