This petition under Section 528 Bharatiya Nagarik Suraksha Sanhita, 20231 is directed against order dated 9th October, 2025, passed by the ACJM (North), Rohini Courts, Delhi, whereby, on a fresh complaint filed by the Petitioner, the matter has been directed to be listed for pre-summoning evidence on 30th March, 2026. The Petitioner's request for an earlier date was declined, notwithstanding the fact that the Petitioner is a senior citizen. The Trial Court observed that an earlier date was not available, as the Court is burdened with a pendency of more than 4,000 cases, and priority is being accorded to matters where the accused is in custody or where the case has been pending for more than ten years.

This Court finds no basis to exercise its inherent jurisdiction to interfere with the impugned order, which is founded on practical considerations and the prioritisation of matters involving personal liberty or 1 "BNSS"
