The Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the Petitioner for quashing of the FIR bearing No. 89/2021 dated 21.02.2021 under Sections 376 IPC and Section 4 of POCSO Act, registered at Police Station Bawana in terms of the Settlement dated 09.12.2024.

The allegations in the FIR are that the Prosecutrix aged about 16 was going towards her school when the Petitioner who was her neighbour took her on a motorcycle to a room, where he committed the wrong act. It is further submitted that a cross-FIR No.92/2021 under Section 323/354/354D IPC and Section 12 POCSO Act was registered on the Complaint of the niece of the Complainant against the Uncle of the Prosecutrix, but the same The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. was closed since both the Complainant as well as the Accused in the FIR was juvenile.

It is submitted that both the petitioner and Respondent No. 2 have already sorted out their all differences with the intervention of their respective persons of the vicinity vide Memorandum of Understanding dated 09.12.2024 and they have left no grudge or grievance against each other in any manner whatsoever. It is further submitted that the Agreement has been arrived at between the parties without any pressure, force or coercion. Therefore, the Petition be quashed. It is further submitted 4.

The complainant is present in the Court and submits that the matter stands settled with the Petitioner. She has no objection if the FIR is quashed against the petitioner on account of the Settlement dated 09.12.2024 already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 89/2021 registered at Police Station Bawana, for offences punishable under Sections 376 IPC and Section 4 of POCSO Act with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner herein.

The Petition stands disposed of.
