The parties have amicably resolved the disputes and have filed the joint application under Order XXII Rule 3 of the Code of Civil Procedure. The terms of the settlement are recorded in the compromise deed dated 22nd October, 2018 which has been filed along with the application. The application is supported by the affidavits of the parties. Mr. Vinay Gugnani, plaintiff and Mr.Shankar Swaroop Mathur, defendant No.1 are present in Court with their counsels and they confirm the settlement Ex.C-1. The application along with affidavits and the compromise deed dated 22nd October, 2018 is marked as Ex.C-1.

The settlement between the parties is lawful and is recorded. I.A.14756/2018 is allowed and the suit for specific performance of agreement to sell dated 26th June, 2007 (Ex.PW-1/1A) and possession of suit

property is decreed in terms of the settlement Ex.C-1. Ex.C-1 shall form part of the decree.

The parties shall remain bound by the terms of the settlement, Ex.C-1.

The pending application is disposed of.

The amount deposited by the defendant with the Registrar General of this Court be released to defendant No.1 after handing over the possession in terms of the settlement, Ex.C-1.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
