Heard the learned counsel for the parties.

By instituting this petition, a prayer has been made to quash the decision of the tendering authority whereby the petitioner's bid has been rejected, allegedly as per Clause 2(16) of the Buyer Added Bid Specific Additional Terms and Conditions. Clause 2(16) provides that the tendering authority reserves the right to disqualify any bidder at technical evaluation stage based on unsatisfactory services or poor performance rendered by the bidder in any contract awarded by the tendering authority in past. There is nothing on record from where we can gather this specific reason as to why the petitioner's bid has been rejected.

respondent no.2. Learned counsel representing the respondent no.2, on instructions, has stated that all the representations received from those tenderers whose bids have been rejected are under consideration, including that of the petitioner and further that the authority concerned will attend to those representations first only then the tender shall proceed further. 4.

Accordingly, we dispose of this writ petition in terms of the statement made by learned counsel representing the respondent no.2 and direct that the representation made by the petitioner for redressal of the grievances shall be considered and decided by the Competent Authority of respondent no.2 by passing a reasoned and speaking order. The order so passed may be communicated to the petitioner forthwith only thereafter the further tender process pursuant to the subject tender shall proceed.
