% 03.08.2017 W.P.(C) 3932/2014 & CM APPL. 11975/2017 (restoration) Heard on the application seeking restoration of the petition, which was disposed off in default on 28.02.2017 as also on merits in terms of the last order of this Court.
Application seeking restoration is allowed.
As regards the merits of the petition, it is not in dispute that the subject agitated in the writ petition was resolved before Permanent Lok Adalat on 09.01.2014, and, a settlement came to be recorded. Mr. Sanjay Gupta. Ld. counsel for the petitioner strenuously contends that the petitioner never instructed anyone to go for Permanent Lok Adalat and settle the matter on behalf of the petitioner. Whether the person appearing for the petitioner before Permanent Lok Adalat was duly
authorised by the petitioner or not, cannot be gone in the instant proceedings.
Suffice to say, as long as the settlement in PLA is concerned, that is binding on the parties and no challenge can be extended to it in the instant proceedings.
Dismissed.
It is however, clarified that the petitioner would be at liberty to take any other legal recourse, if, any available to the petitioner.
